These Terms & Conditions ("Terms") govern your access to and use of the Tsoko Art Advisory website (the "Site") and any purchase of artworks or services made through it. By browsing the Site or placing an order, you agree to be bound by these Terms. Please read them carefully. If you do not agree, please do not use the Site.
1. Who we are
Tsoko Art Advisory ("we", "us", "our") is an art advisory and curatorial platform based in South Africa, connecting collectors with emerging and renowned South African artists. You can reach us at mpumi@tsokoart.com.
2. The artworks
We make every effort to display the colour, texture, dimensions and detail of each artwork as accurately as possible. Because every piece is an original or limited work, slight variations in colour and finish may occur, and screen settings may affect how a work appears. Such variations are inherent to original art and are not defects.
All artworks are subject to availability. Where a work is marked as sold or reserved, it is no longer available for purchase. Prices are listed in South African Rand (ZAR) and include VAT where applicable, unless otherwise stated.
3. Orders and acceptance
Placing an order is an offer to purchase. An order is only confirmed once we have accepted it and payment has been received in full. We reserve the right to decline or cancel an order — including where a work is no longer available, where there has been a pricing or description error, or where payment cannot be verified. If we cancel a confirmed order for such reasons, any amount paid will be refunded.
4. Pricing and payment
Payments are processed securely through our third-party payment providers, including Payfast and Ozow. We do not store your card or banking details on our servers. By submitting payment, you confirm that you are authorised to use the chosen payment method. Ownership of an artwork passes to you only once payment has cleared in full.
5. Delivery
Delivery arrangements, timeframes and costs are set out in our Delivery Policy, which forms part of these Terms.
6. Returns and refunds
All sales are final. Our full position on returns, exchanges and refunds — including your rights in respect of works that arrive damaged or that are not as described — is set out in our Refund & Returns Policy, which forms part of these Terms.
7. Intellectual property
All content on the Site — including images of artworks, text, logos and design — is owned by Tsoko Art Advisory, the respective artists, or their licensors, and is protected by copyright and other laws. Purchasing an artwork transfers ownership of the physical work only. It does not transfer copyright or any reproduction rights, which remain with the artist. You may not reproduce, distribute or commercially exploit any content from the Site without prior written permission.
8. Acceptable use
You agree to use the Site only for lawful purposes and not to interfere with its operation, security or availability, or with other users' enjoyment of it.
9. Limitation of liability
The Site is provided "as is". To the extent permitted by law, we will not be liable for any indirect or consequential loss arising from your use of the Site. Nothing in these Terms limits or excludes any rights you have under the Consumer Protection Act 68 of 2008 or other applicable law that cannot lawfully be limited or excluded.
10. Privacy
We process your personal information in line with the Protection of Personal Information Act (POPIA). We collect only what we need to fulfil your order and respond to your enquiries, and we do not sell your information. For any privacy request, contact us at mpumi@tsokoart.com.
11. Governing law
These Terms are governed by the laws of the Republic of South Africa, and any dispute will be subject to the jurisdiction of the South African courts.
12. Changes to these Terms
We may update these Terms from time to time. The version published on the Site at the time you place an order is the version that applies to that order.
